Sand Castle on the Beach

These Terms and Conditions (“Terms”) are a binding agreement between you and RonCan, Inc., doing business as Sand Castle on the Beach (“Sand Castle,” “we,” “us,” or “our”), a U.S. Virgin Islands corporation located at Veteran’s Shore Drive vs. 127 Smithfield, Frederiksted, St. Croix, U.S. Virgin Islands 00840.
These Terms apply when you use sandcastleonthebeach.com (the “Site”), make a reservation with us through any channel, or stay at the resort. By using the Site or booking a stay, you accept these Terms. If you do not accept them, do not use the Site or book with us.
Our Hotel and Travel Policies are part of these Terms and are incorporated by reference. That page covers arrival and departure, housekeeping, parking, pets and service animals, our smoke-free policy and associated charges, damage to hotel property, guest conduct, and related operational rules. If these Terms and the Hotel and Travel Policies address the same subject, the Hotel and Travel Policies control for on-property matters.
1. An Adults-Only Resort
Sand Castle on the Beach is an adults-only property. Overnight guests must be 16 years of age or older. The person making a reservation must be at least 21 years of age and must secure the reservation with a major credit card. Limited daytime access to beach facilities for visitors under 16 is described in the Hotel and Travel Policies.
2. Reservations, Rates, and Payment
All reservations are subject to availability. A reservation is confirmed when we receive a deposit of 50% of the room charges (before tax), secured by a major credit card. Debit cards are not accepted as payment.
Rates are quoted in U.S. dollars. Unless stated otherwise at booking, rates are based on double occupancy, except the Double Queen Studio and the Dolphin Villa, which are based on quadruple occupancy. An extra person charge of $60.00 per person, per night applies above those occupancy levels. A 12.5% U.S. Virgin Islands hotel tax is added to every reservation.
By making a reservation, you authorize us to charge your card for the deposit, the balance of your stay, and any fees or charges described in these Terms or in the Hotel and Travel Policies, including incidental, damage, and smoking recovery charges.
If a rate or availability error appears on the Site or in a confirmation, we may correct it. If the corrected rate is higher than the rate you booked, you may accept the corrected rate or cancel for a full refund of amounts paid.
If you book through a third-party travel site or agency, that company’s payment and cancellation mechanics govern your transaction with them. These Terms and the Hotel and Travel Policies still govern your stay at the resort.
3. Cancellations, No-Shows, and Early Departures
Reservations must be cancelled at least 30 days before arrival to avoid penalty. If you cancel within 30 days of arrival, you forfeit 100% of the deposit. A reservation determined to be a no-show forfeits the entire deposit. No refunds are issued for unused room nights due to early departure, except as described in Section 4.
We recommend travel insurance for all stays.
4. Hurricanes and Force Majeure
If St. Croix is under a hurricane warning, guests holding a reservation may cancel without penalty and rebook within one year of the original arrival date. Rebooking requests must be submitted in writing within 90 days of the original check-in date. If you rebook from low season into high season, the rate difference applies. Guests already at the resort who depart early due to weather will be refunded for unused room nights. If governmental authorities recommend evacuation and you are unable to leave the island, we will provide accommodations at a reduced emergency rate set by the hotel.
We are not liable for failure to perform caused by events beyond our reasonable control, including natural disasters, government actions, utility failures, or interruptions of transportation.
5. Conduct at the Resort
Guest conduct expectations, our dress code, the clothing-optional courtyard pool, and our right to remove guests for disruptive behavior are set out in the Hotel and Travel Policies. Sand Castle does not discriminate based on race, color, religion, sexual orientation, national origin, gender, or gender identity. Personal behavior is the only cause for removal from the hotel.
6. Using This Website
You may use the Site only for lawful purposes. You agree not to:
- Make false, fraudulent, or speculative reservations, or reservations in anticipation of demand
- Scrape, harvest, or copy Site content or data by automated means
- Interfere with the Site’s operation or attempt to bypass its security measures
- Use the Site in any way that violates applicable law
We may suspend or terminate access to the Site for violations of these Terms.
7. Intellectual Property
The Site and its content, including text, photographs, video, graphics, logos, and design, are owned by RonCan, Inc. or its licensors and are protected by copyright and trademark law. The Sand Castle on the Beach name and logo are our marks. You may view and print Site content for personal, non-commercial use in planning or booking a stay. Any other use requires our prior written permission.
8. Third-Party Content, Links, and Booking Platforms
The Site includes content and tools supplied by third parties, such as our online booking engine, links to travel platforms, island event listings, weather forecasts, and a live beach camera feed. These are provided for convenience. We do not control third-party content and do not guarantee its accuracy, completeness, or availability. Event details and weather forecasts change; confirm anything you are relying on before you travel. Third-party sites and services are governed by their own terms and privacy policies.
9. Content You Send Us
If you send us reviews, photographs, testimonials, or other materials, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display them in connection with operating and promoting the resort. Only submit content you have the right to share. We may decline or remove submitted content at our discretion.
10. Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, Sand Castle will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of the Site, a reservation, or a stay. Our total liability arising out of your use of the Site will not exceed one hundred dollars ($100). Our total liability arising out of a reservation or stay will not exceed the amounts you paid us for the stay giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless RonCan, Inc., its owners, officers, and employees from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy and Cookie Policy, which are part of these Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the United States Virgin Islands, without regard to conflict of law principles. Any dispute arising out of these Terms, the Site, or a stay will be brought exclusively in the local or federal courts located on St. Croix, U.S. Virgin Islands, and you consent to their jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. Changes take effect when posted. Your continued use of the Site or a new reservation after changes are posted constitutes acceptance. The version in effect when you booked governs that reservation.
16. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Hotel and Travel Policies, the Privacy Policy, and the Cookie Policy, are the entire agreement between you and us regarding the Site and your reservation. You may not assign your rights under these Terms; we may assign ours in connection with a sale or reorganization of the business.
